تحلیل راهبردی نقش شورای نگهبان در پایداری نظام سیاسی جمهوری اسلامی ایران براساس نظریه ساختاری-کارکردی

چکیده
پس از پیروزی انقلاب اسلامی و شکل‌گیری نهادهای انقلابی در عرصه سیاست داخلی و حکمرانی ملی، ایجاد نهادی جهت نظارت و مدیریت مقررات جهت انطباق آن‌ها با قوانین شرعی به‌منظور حفظ دستاوردهای نظام اسلامی در دستورکار نخبگان سیاسی انقلابی قرار گرفت. کارکرد نهادهای تازه تأسیس مشخص بود و برای تقویت نظام اسلامی در ابعاد محتوایی و کارکردی ایجاد می‌شدند. شورای نگهبان ازجمله نهادهای انقلاب است که از کارکردهای متنوعی جهت استحکام نظام اسلامی برخوردار است. ماهیت حقوقی و فقهی این نهاد سبب شده است تا کارویژه نظارتی آن به شکل برجسته‌ای مطرح شود. در پژوهش پیش رو نگارندگان به دنبال بررسی کارکرد شورای نگهبان در نظام سیاسی جمهوری اسلامی ایران براساس نظریه ساختاری کارکردی است. ازاین‌رو سؤال ذیل مطرح می‌شود که در ساختار جمهوری اسلامی ایران، شورای نگهبان از چه کارکردی برخوردار است؟ در پاسخ به سؤال فوق فرضیه ذیل مطرح می‌شود که شورای نگهبان در ساختار نظام جمهوری اسلامی ایران از کارکرد حیاتی در حوزه نظارت سیاسی، حقوقی و فقهی برخوردار است. روش پژوهش در مقاله حاضر توصیفی- تبیینی و روش جمع‌آوری منابع اسنادی است.

چکیده English

After the victory of the Islamic Revolution and the formation of revolutionary institutions in the field of domestic politics and national governance, the establishment of an institution to supervise and manage regulations to ensure their compliance with Islamic law, in order to preserve the achievements of the Islamic system, became a priority for the revolutionary political elite. The function of these newly established institutions was clear, and they were created to strengthen the Islamic system both in terms of content and functionality. The Guardian Council is one of the institutions of the revolution that performs multiple functions aimed at strengthening the Islamic system. Its legal and jurisprudential nature has led to its special supervisory function being particularly prominent. In the present study, the authors seek to examine the function of the Guardian Council in the political system of the Islamic Republic of Iran using structural-functional theory. Hence, the following question is raised: “What is the function of the Guardian Council within the structure of the Islamic Republic of Iran?” In response to the above question, the following hypothesis is proposed: the Guardian Council has a vital function in the field of legal-jurisprudential supervision within the structure of the Islamic Republic of Iran. The research method employed in the present article is descriptive-explanatory, and the method of data collection is based on documentary sources.
