شناسایی راهکارهای جلب مشارکت مردم و نخبگان در نظام قضایی

چکیده

در نظام‌های قضایی توسعه‌یافته، یکی از عناصر مهم کارآمدی، مشارکت ذینفعان است که به حل تعارضات موجود در نهادهای قضایی کمک شایانی می‌کند. مشارکت از شاخص‌های اصلی توسعه سیاسی و اجتماعی برای ارتقاء جامعه بوده و از اهمیت فوق العاده‌ای برخوردار است. بر این مبنا، هدف پژوهش حاضر، ارائه دسته‌بندی جامعی از راهکارهای جلب مشارکت مردم و نخبگان در نظام قضایی با روش تحلیل مضمون است. جمع‌آوری داده‌ها از نظر زمان پژوهش، مقطعی است. در پژوهش حاضر، 15 نفر از اساتید دانشگاه، پژوهشگران و کارکنان بخش‌های گوناگون قوه قضائیه از طریق نمونه‌گیری هدفمند با استفاده از تکنیک حداکثر تنوع انتخاب شده و با آن‌ها به صورت نیمه‌ساختاریافته، مصاحبه صورت گرفت. داده‌های حاصل از مصاحبه‌ها از طریق روش تحلیل مضمون، تحلیل شد. فرایند انتخاب، مصاحبه و تحلیل تا حصول به اشباع نظری، ادامه یافت. داده‌های جمع‌آوری شده در مرحله نخست، در قالب 97 کد اولیه و در مرحله دوم در قالب 49 مضمون پایه دسته‌بندی شد. از تحلیل مضامین پایه، 6 مضمون سازمان‌دهنده به دست آمد. در نهایت مضامین سازمان دهنده، در قالب 2 مضمون فراگیر جای گرفت. یافته‌های پژوهش حاکی از آن است که راهکارهای جلب مشارکت مردم و نخبگان در نظام قضایی در قالب شش دسته مضمون (ساختاری، زمینه ای، مدیریتی، فردی، فرهنگی-میان فردی، و قانونی) قابل احصا و دسته‌بندی است.

چکیده [English]

In developed judicial systems, one of the important elements of effectiveness is the participation of stakeholders, which helps to resolve conflicts in judicial institutions. Participation is one of the main indicators of political and social development for the improvement of society, and it is extremely important. Based on this, the aim of the current research is to present a comprehensive classification of strategies to attract the participation of people and elites in the judicial system with the method of thematic analysis. Data collection is cross-sectional in terms of research time. In the present study, 15 university professors, researchers and employees of various departments of the judicial system were selected through purposive sampling using the maximum diversity technique and semi-structured interviews were conducted with them. The data obtained from the interviews was analyzed through thematic analysis method. The process of selection, interview and analysis continued until reaching theoretical saturation. In the first stage, the collected data were categorized in the form of 97 primary codes and in the second stage in the form of 49 basic themes. From the analysis of the basic themes, 6 organizing themes were obtained. Finally, the themes of the organizer were placed in the form of 2 global themes. The findings of the research indicate that the strategies to attract the participation of people and elites in the judicial system can be counted and categorized in the form of six themes (structural, contextual, managerial, individual, cultural-interpersonal, and legal).
