Within the strategic frameworks of rule making, enforceable norms frequently emerge from customary contexts and subsequently attain sophistication through philosophical, theological, and juridical elaboration. The central inquiry animating this study is thus: What is the role and status of custom within the legislative policy and the rule making paradigm of Iran? More specifically, does custom possess normative validity in the strategic orientation and procedural mechanisms of the Iranian legal order? Drawing upon the findings of this research, the authors maintain that, in Iranian law—grounded in Imami jurisprudence—custom lacks autonomous rule making authority and cannot serve as an independent source of normative legitimacy for statutes or legal rules. Nevertheless, the derivative or instrumental validity of custom is acknowledged in several domains: the identification of factual subjects, the interpretation of contractual language, the application of statutory provisions to concrete instances, and the supplementation of legislative texts. Employing a descriptive analytical methodology and relying on library-based data collection, this study systematically explicates and substantiates the foregoing thesis through rigorous scholarly documentation and argumentation.</span> <span lang="FA">نقش و کاربست عرف در شکل‌گیری برخی از نظام‌های حقوقی و نیز در فرایند قاعده‌سازی، بر کسی پوشیده نیست. در راهبرد قاعده‌سازی نظام‌های مذکور، قواعد لازم الاجرا در یک ظرف و بستر عرفی شکل گرفته و آنگاه،</span><span dir="LTR" lang="FA"> </span><span lang="FA">به یاری نظریات و انگاره‌های فلسفی، دینی و حقوقی،</span><span dir="LTR" lang="FA"> </span><span lang="FA">به تکامل می‌رسد. سؤالی که در اینجا مطرح می‌شود و داعی اصلی و دغدغه فکری نگارندگان در انجام این پژوهش بوده آن است که عرف در سیاست تقنینی و قاعده‌سازی ایران، چه نقش و جایگاهی دارد؟ و آیا عرف در راهبرد و نیز فرایند قاعده‌سازی نظام حقوقی ایران واجد اعتبار است یا خیر. ازهمین‌رو و با امعان نظر به یافته‌های حاصل از پژوهش پیش رو، اعتقاد نگارندگان بر آن است که عرف در حقوق ایران، منبعث از فقه امامیه واجد قدرت قاعده‌سازی نیست و نمی‌تواند منشأ اعتبار قواعد و قوانین باشد. بااین‌حال، اعتبار آلی عرف در تشخیص موضوعات، تعیین معانی و مفاهیم عبارات عقود، تطبیق احکام قانونی با مصادیق و تتمیم قانون، مقبول و مورد پذیرش است. در این پژوهش که با روش توصیفی-تحلیلی و گردآوری اطلاعات به شیوه کتابخانه‌ای صورت پذیرفته، نظر مزبور براساس مستندات متقن و مبرهن علمی، تشریح و تبیین خواهد شد.</span> https://rahbord.csr.ir/article_241875_6b0d40b1134ea17b6a410359e1d95e69.pdf
