«بطلان سود بدون عهده» در بازارهای مالی اسلامی

چکیده

بطلان ربح ما لم یضمن (سود بدون عهده) قاعده‌ای است اصطیادی که برگرفته از حدیث نبوی(ص) و به معنای بطلان سود در رابطه‌‌ای است که سود برنده هیچ نوع تعهد یا ضمانتی در آن رابطه ندارد. از مصادیق روشن این قاعده، سود بردن از طریق قرض ربوی است. با بررسی مجموعه قواعد و احکام فقهی به این حقیقت دست می‌یابیم که پول یا هر مال «که مالکیت به آن تعلق می‌گیرد» هرگاه به‌عنوان قرض به‌شرط تضمین اصل و سود در اختیار شخصی قرار گیرد، از دایره تولید، نفع و سودآوری خارج‌شده است، زیرا اصل پول تضمین‌شده و هرگاه سرمایه‌ای تضمین‌شده باشد، سود مشروع به همراه ندارد. در قراردادهای مضاربه و شرکت نیز سرمایه، تضمین نشده و اگر خسارتی در خریدوفروش پدید آید، خسارت متوجه سرمایه و سرمایه‌دار است. ازاین‌رو، بسیاری از فقها گفته‌اند در مضاربه اگر مالک سرمایه شرط کند که خسارت بر عهده مالک نباشد مضاربه باطل است. این قاعده کاربردهای مهمی در ابواب متعدد از فقه معاملات، نظریات اقتصادی و بازارهای مالی دارد و هرکجا که سود و عایدی ناشی از رابطه بدون ضمانت و ناشی از عدم به‌کارگیری در فعالیت‌های اقتصادی (کار) باشد این سود شبهه ربوی دارد. لذا چنانچه در سپرده‌های بانکی، سود پرداختی به سپرده‌گذار از طریق به‌کارگیری سرمایه در عقود اسلامی حاصل نشده باشد و یا چنانچه سود پرداختی به صاحبان اوراق مشارکت و یا صکوک ناشی از سود واقعی طرح نباشد، پرداخت سود با روح مشارکت منافات خواهد داشت

Invalidity of the guaranteed profit without undertaking any obligation, risk or charge (Botlane rebhe ma lam yozman) is an extractive (Estyady) rule derived from the Hadith of the Prophet (PBUH). According to this rule wherever profits or proceeds on capital (money), arise from the contractual relations without undertaking any risk, act or economic activity by the investors, must be considered as usury (Reba), which is absolutely forbidden in Islamic law. A clear example of this rule is guaranteed or fixed rate of interest through interest loans. The rule applies on all fields of financial instrument, securities, options, and debt documents, contracts, banking operations, productions and financial services. In Mudaraba contracts, e.g., parties’ interests (capital, interests entitled by trusteeship, agencies or management services) cannot exclude from the business normal risk. In other words, the agent (the party who manages the business in return of the portion of the acquired profit) cannot be obliged to guarantee the project profitability, or to pay a fixed rate on this business. So, no party can be completely excluded from the risks, or losses arise. Consequently, such damages or losses should be allocated to all parties respectively.
