Ijtihad is one of the important conditions for becoming a judge in Islamic jurisprudence about which different viewpoints have been expressed. Most Muslim jurists, including Imam Khomeini, believe in ijtihad as a necessary condition for judgment. On the opposite, there is a group of mostly contemporary jurists who despite the dominant view, do not believe in the necessity of ijtihad as a qualification for judgment. Apparently, their evidence is stronger than the prevalent viewpoint of jurists and they can prove that ijtihad is unnecessary as a precondition for judgment – of course, if the informed follower of faqih (Muslim jurist) is aware of its principles and is qualified in other respects. Presuming the necessity of ijtihad, judgment by an appointed follower or proxy on behalf of mujtahid would not be authorized. However, presuming that ijtihad is not necessary condition for judgment, it would be authorized to appoint a follower to do judgment. It seems that even if ijtihad is considered necessary as a cautionary measure and due to Islam’s strict recommendation for protecting the life, property and honor of people, in emergency cases and when a mujtahid judge is not at hand, judgment of a follower would be authorized in order to prevent disruption in the judicial system and difficulty for people}, keywords = {Judgment,Ijtihad,appointed judge,authorized judge,follower}, title_fa = {قضاوت غیرمجتهد در فقه امامیه با رویکردی به نظر امام خمینی(ره)}, abstract_fa = {با توجه به اینکه قضاوت یکی از مباحث مهم و ضروری فقه و حقوق محسوب می‌شود، شرایط قاضی نیز از اهمیت بالایی برخوردار است. از جمله شرایطی که برای صلاحیت قاضی، خصوصاً در فقه، حائز اهمیت دانسته شده است، اجتهاد می‌باشد که مورد اختلاف نیز هست. مشهور فقها قائل به لزوم اجتهاد در قضاوت هستند که امام خمینی نیز با ایشان هم‌عقیده می‌باشند. در مقابل، گروهی از فقها که اغلب از معاصرین هستند، بر خلاف قول مشهور، شرط اجتهاد را در قضاوت، لازم نمی‌دانند. ظاهراً ادله ایشان از ادله مشهور فقها قوی‌تر بوده، و عدم لزوم اجتهاد در قضاوت را ـ البته در صورت مأذون بودن مقلد آگاه به احکام و دارای سایر شرایط‌ ـ ثابت می‌نماید. به فرض قبول لزوم اجتهاد، قضاوت مقلد منصوب و وکیل از سوی مجتهد جایز نمی‌باشد، اما بنابر قول به عدم لزوم اجتهاد، نصب و توکیل مقلد در مقام قضا جایز می‌باشد. به‌نظر می‌رسد حتی اگر به علت توصیه اکید اسلام در خصوص جان و مال و آبروی مردم، احتیاط کرده و شرط اجتهاد را لازم بدانیم، اما در صورت اضطرار و عدم دسترسی به قاضی مجتهد، برای جلوگیری از اختلال نظام و عسر و حرج مردم، قضاوت مقلد صحیح می‌باشد}, keywords_fa = {قضاوت,اجتهاد,قاضی منصوب,قاضی مأذون,مقلد}, url = {https://rahbord.csr.ir/article_124459.html}, eprint = {https://rahbord.csr.ir/article_124459_acd727bc78769660b1e27f8d77ba8db4.pdf} }
